Terms of Use
These Terms of Use govern access to the Cypher Trace website and case-assessment services. By using the website or submitting a case, you agree to these Terms.
1. Nature of the Service
Cypher Trace provides cryptocurrency scam case assessment, blockchain transaction tracing, documentation, and recovery-assistance related services. A website submission is an initial assessment request only and does not create a legal, fiduciary, law-enforcement, custodial, or attorney-client relationship.
2. No Guarantee of Recovery
Blockchain transactions may be traceable without being recoverable. We do not guarantee that funds can be frozen, seized, returned, or recovered, and we do not guarantee any specific timeline or result.
3. Fees
The website describes an intended model of no upfront recovery fee and a 10% success fee calculated on funds actually recovered and returned to the client. Any binding fee obligation, definition of a successful recovery, scope of work, and payment terms must be stated in a separate signed service agreement applicable to an accepted case. Submitting the website form alone does not create a fee obligation.
4. Case Eligibility
We may accept, decline, pause, or request more information about any case. Factors may include transaction evidence, timing, blockchain network, destination services, reported loss, jurisdiction, available documentation, conflicts, legal considerations, and operational capacity.
5. Information You Submit
You agree to provide information that is accurate to the best of your knowledge and that you have the right to provide. Do not submit another person's private information unless you are authorized to do so.
6. Security Restrictions
Do not send seed phrases, recovery phrases, private keys, wallet passwords, exchange passwords, one-time authentication codes, or other credentials that can control assets or accounts. We do not require these credentials for an initial assessment.
7. No Custody or Authority
Unless separately agreed in a lawful written arrangement, Cypher Trace does not take custody of client cryptocurrency or claim the authority of a court, regulator, exchange, bank, or law-enforcement agency. Only competent institutions and authorities can exercise powers available to them under applicable rules and law.
8. Third-Party Services
Investigations and recovery efforts may involve exchanges, banks, wallet providers, blockchain analytics services, legal professionals, law-enforcement agencies, regulators, or other third parties. We do not control their decisions, response times, policies, or outcomes.
9. Acceptable Use
You may not use the website to submit false claims, impersonate another person, harass others, distribute malware, attempt unauthorized access, interfere with the service, or use the service for unlawful activity.
10. Privacy
Our collection and use of personal information is described in our Privacy Policy.
11. Website Availability and Changes
We may modify, suspend, or discontinue website features, forms, policies, or service descriptions. We may also update these Terms by posting a revised version with a new effective date.
12. Disclaimers
The website and initial assessment are provided on an "as available" basis to the extent permitted by applicable law. Information on this website is general information and is not legal, tax, investment, or financial advice.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Cypher Trace will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of the public website. Nothing in these Terms excludes liability that cannot legally be excluded. Any case-specific liability terms may be addressed in a signed service agreement.
14. Governing Terms for Accepted Cases
If a case is accepted, a separate written service agreement may contain additional terms, including scope, fees, jurisdiction, dispute provisions, confidentiality, and termination. If that signed agreement conflicts with these website Terms regarding the accepted case, the signed agreement will control to the extent of the conflict.
